In English v Thomas Sanderson Ltd [2008] EWCA Civ 1421, the Court of Appeal held that under the Employment Equality (Sexual Orientation) Regulations 2003 (SI 2003/1661) that harassment at work on the grounds of sexual orientation may occur irrespective of the victim’s actual sexual orientation or the tormentors’ perception of his orientation.
